Charlotte was born with brain, lung and kidney damage
A severely brain-damaged baby should be allowed to die if she stops breathing, a High Court judge has ruled.
The parents of 18-month-old Charlotte Wyatt have lost their legal battle to overturn a court order allowing doctors not to resuscitate her.
Darren and Debbie Wyatt, from Portsmouth, had been fighting the ruling, made in October.
But Mr Justice Hedley said that the new order was not open-ended and remained subject to review.
Doctors said Charlotte has "no feelings other than continuing pain", and earlier the court had heard how experts believed her life was "intolerable".
But the Wyatts believe Charlotte is improving.
Passing the ruling Mr Hedley said: "I am quite clear that it would not be in Charlotte's best interests to die in the course of futile aggressive treatment."
He said that if she should stop breathing all treatment, except intubation and ventilation, would be in Charlotte's best interests, "but nothing further".
Charlotte was born three months premature at St Mary's Hospital, Portsmouth, in October 2003, with serious brain, lung and kidney damage.
In October doctors at the hospital won the legal right not to resuscitate her.
But it now seems that Charlotte could survive for a considerable time, possibly even years, but the medical prognosis for her quality of life is bleak.
Q: What was the case about?
Doctors at the Portsmouth Hospitals NHS Trust said they believed if she stopped breathing they should not revive her as her quality of life would be so poor and be dominated by pain.
But her parents, Darren and Debbie, disagreed, saying she deserved every chance.
The case first came to the High Court last October when the judge sided with doctors.
It was brought back to the High Court again this year by the parents, but the judge has refused to overturn the original decision.
Although he said the decision should remain subject to review.
Q: Why do the doctors not want to resuscitate Charlotte?
They said there is no way her life can improve. Despite their best efforts, she is in constant pain and reviving her would not be beneficial because her quality of life would be so poor.
She also has no prospect of living beyond infancy.
She is kept in hospital and there is little prospect of her ever being allowed home at the moment, doctors have claimed.
Q: What do her parents say?
Charlotte's parents, both committed Christians, believe she is developing.
They have told the court that she can see and, to a limited extent, hear. She also smiles.
This was in contrast to her condition when the case first came to court last October when she was almost totally unresponsive.
Q: Don't parents have the final say on treatment?
No. Doctors can refuse to treat a person if they feel the treatment serves no purpose or if the quality of life is deemed to be so low that it is not in the patient's interest.
However, if the family and doctors disagree it is left to the High Court to decide.
Q: Was this the first case of its kind?
It was not the first time doctors and parents have ended up in court in these situations but previous hearings have been held in private.
Both Charlotte's parents and the Portsmouth Hospitals NHS Trust agreed to it being held in the open court because they felt it was in the public interest.

The cases of Luke Winston-Jones and Charlotte Wyatt case have triggered a debate about how long doctors should keep treating patients when they are seriously ill.
A High Court judge ruled that Luke, who has the rare genetic condition Edwards syndrome, should not be resuscitated should if his condition worsens.
His case follows that of baby Charlotte Wyatt. Earlier this month, a High Court judge ruled in favour of doctors who argued the premature 11-month-old girl's quality of life would be so poor that she should not be resuscitated if she stops breathing.
Her parents had appealed to Mr Justice Hedley during the two-day hearing last week that everything should be done for her as she was a "fighter".
But doctors told the court her life would be dominated by pain if she kept being treated.
It was the first time a case like this has been held in an open court.
And with medical advances being made all the time, doctors are facing the difficult question about whether it is right to stop treating desperately ill people.
Richard Nicholson, editor of the Bulletin of Medical Ethics, told BBC News Online that during the 1980s and 1990s there was almost a competition among doctors to keep premature babies alive.
Constant pain
"One of the substantial side effects of medical advancements is that we can keep the body alive almost regardless of how severely damaged it has become."
And he acknowledged the same sort of issues were cropping up in the treatment of elderly and terminally ill patients.
Dr Sarah Jarvis, a GP who has seen a number of cases where people are suffering and in constant pain, told BBC Five Live society was struggling to keep up with science.
"We probably do not know enough about the doctors intentions to know whether it is a case of euthanasia or not"

"We have to remember 10 years ago there would have been virtually no prospect of a baby born at this stage surviving.
"The problem is medical advances are galloping ahead so fast that we have reached the stage where we are keeping babies alive when perhaps 50% are going to have profound neurological difficulties."
But she insists the Charlotte case was different from the debate about euthanasia.
"Euthanasia is actively helping to end someone's life and that is illegal in this country.
"There is a big difference between that and not resuscitating."
Others remain less convinced.
Debate
Anthony McCarthy, from the Linacre Centre, a health care ethics organisation linked to the Catholic Church, said: "We probably do not know enough about the doctors intentions to know whether it is a case of euthanasia or not."
He also believes the case has opened up the debate about whether parents or doctors should have the final say on treatment.
"Parents should have the first say but parents are not always infallible.
"It is possible that parents may want to continue treatment that may be burdensome."
Doctors have the right to refuse to treat a patient if they feel it is in the person's best interests - although if the patient's family disagree the case can end up in court.
Dr Michael Wilks, of the British Medical Association's ethics committee, said the decision is taken if the treatment serves no purpose or if the quality of life is deemed to be so low that it is not beneficial.
He said: "A doctor's job is to make clinical judgements about whether treatment is appropriate or not. If it is not appropriate it should be withdrawn."
And he said while it was difficult, the public should also consider the wider implications of giving treatment.
"Every time we give unnecessary treatment we spend NHS resources and deprive someone else of these resources."

I am a journalist in the U.S. The BBC is "public" in the sense that it is government agency. (How critical will the government ever be of itself? There is a limit.) People in England pay the equivalent of about $200 per year for a license in order to own a TV.
Also, unlike the United States, England doesn't have any Freedom of Information laws (also called "sunshine" laws). If you're not familiar with the U.S. Freedom of Information Act of 1996, it's the reason that the American public (including journalists) has open access to millions of government records — all the way from being able to check out the expense accounts of your local school superintendent or county sheriff up to the Associated Press's recent FOI request for documents detailing the testimony of hundreds of Guantanamo Bay detainees who are contesting their detainment.
I've lived in both England and the United States, and the BBC certainly has its strengths, but American journalism (especially newspaper journalism — TV "news" is a different bag), despite its flaws, should not be taken for granted.

Totally wrong. It is an independent body with its own governing body, not answerable to the government. The BBC has openly challenged Blair on the Iraq war for instance... in a way no US media has dared.

BBC news is more independant, not owned by right wingers, better written and contains mature analysis. The US just has nothing near it. CNN is different again - raw news - but network news in the is risible.
There is also ITN in the UK - commerical news of very high qulaity, andf C$ news which is critical and political - there is simply nothing to match it in the US - which is why the Terri debate has been dominated by right wing interests and can always be so.
There is the NY Times web site for Amercians who want real news - but like some fo the writers here - I agree that the BBC is unparalleled in the world.
The BBC is shitty, like most news organisations in the world. If you're looking to fly the flag of any media corporation, more fool you. The choice is between evils and lesser evils.

This is correct. In the UK you can get your data from Companies as well as government... there are lots of avoidance routes though.

I will agree that much of the major, mainstream U.S. media has been shamefully soft on the Bush administration — though I hesitate to generalize, since any body of media has many layers. If you feel that no U.S. media has raised challenges to the Bush administration, perhaps you simply haven’t had access to it. Or perhaps you're only watching television.

Legal access to information in the United States is far more extensive than in the U.K. This is due to the First Amendment as well as the U.S. Freedom of Information Act. British libel laws and the British Official Secrets Act, in fact, may inhibit free access to information. I’m not as familiar with your Data Protection Act, but from a cursory overview just now it appears to me that the act also may inhibit, rather than support, access to information. Good journalism certainly can (and does) happen in both environments, but U.S. law is significantly more supportive of someone who is doing investigative journalism. There is simply no question about it.
